1. About us

This website is operated by Lubechem Additives, a business unit of Lubechem Group, with registered office at Plot no. 525D, Kotla Vihar Phase 2, Tilangpur Kotla, New Delhi 110043, India.

2. Website use

By accessing this website you agree to the following: (a) content is provided for informational purposes only and does not constitute a binding offer to supply; (b) you will not attempt to gain unauthorised access, introduce malware, or scrape content systematically; (c) all content (text, images, code, logos) is the intellectual property of Lubechem Group unless otherwise marked.

3. Quotations

Quotations issued by us are valid for 30 days unless otherwise stated. Prices are quoted in INR (domestic) or USD/EUR/AED (export) and exclude taxes, duties, freight, and insurance unless specified in the quotation. Quotations are non-binding offers; a contract arises only on our written confirmation of your purchase order.

4. Order acceptance

Purchase orders are accepted on these terms and on the specific commercial terms in our order acknowledgment. Where there is a conflict between your purchase order terms and our terms, our terms prevail unless we have explicitly agreed otherwise in writing.

5. Specifications & tolerances

Products are supplied to the specifications stated in our Technical Data Sheet (TDS) for the relevant product, within commercial tolerances. We warrant conformity to TDS at the time of dispatch only, as verified by our Certificate of Analysis (COA).

6. Delivery

Delivery terms are as stated in our order acknowledgment using Incoterms 2020 (e.g. EXW, FOB, CIF, CFR, DAP). Delivery dates are estimated in good faith and are not of the essence unless explicitly so stated.

7. Risk & title

Risk passes per the Incoterms rule stated on the order acknowledgment. Title passes upon receipt of full payment, regardless of the Incoterm.

8. Payment

Payment terms are as agreed and stated on the order acknowledgment. Late payments accrue interest at 1.5 % per month or the maximum rate permitted by law, whichever is lower. We may suspend further deliveries while payment is overdue.

9. Inspection & claims

Customers must inspect goods on arrival. Quality claims must be notified in writing within 14 days of delivery with photographic evidence and lot-numbered samples preserved. Quantity claims must be notified within 7 days. Claims not raised within these windows are deemed waived.

10. Limited warranty & liability

We warrant goods conform to the TDS at dispatch. We disclaim all other warranties, express or implied, including merchantability or fitness for a particular purpose, to the maximum extent permitted by law. Our total liability under any order is limited to the invoice value of the affected lot. We are not liable for indirect, consequential, or punitive damages.

11. Force majeure

Neither party is liable for delay caused by events beyond reasonable control, including (without limitation) act of god, war, civil disturbance, pandemic, government restriction, port closure, or supplier failure beyond our control.

12. Intellectual property

All content on this website, all product formulation know-how, and the "Lubechem" brand are property of Lubechem Group. Customer's own formulation IP shared with us under NDA remains the customer's property; we will hold it confidentially.

13. Confidentiality

Each party will keep confidential the commercial and technical information disclosed by the other party in the course of an enquiry or supply relationship.

14. Regulatory compliance

Customer is responsible for ensuring that the goods are imported, stored, used and disposed of in compliance with the laws of the destination jurisdiction. We supply MSDS/SDS, REACH letters, and HS code letters to support customer's regulatory compliance.

15. Governing law & dispute resolution

These terms are governed by the laws of India. Disputes will be referred first to good-faith negotiation, then to arbitration under the Arbitration and Conciliation Act, 1996, seated at New Delhi.
